Ali Amin Gandapur Disqualification Plea Rejected by PHC

The Petitioner’s Key Allegations

Azizuddin Kakakhel Advocate filed the petition. He presented his case to the Peshawar High Court. The petitioner argued that Ali Amin violated his oath. He claimed the CM continuously broke the law. These alleged actions occurred after he assumed office. Kakakhel sought the immediate disqualification of the Chief Minister.

Claims of Political Misconduct

The petition cited several instances of misconduct. It focused on the CM’s political actions. The Chief Minister allegedly launched an “attack on Punjab.” This was done under the pretext of holding a procession. The petition claimed he incited the people. This incitement was directed against the federal government. It also alleged he used official resources for these rallies. This raised questions about misuse of power.

Allegations of Creating Parallel Governance

Kakakhel made other severe accusations. He claimed Gandapur attacked the federal government. This was allegedly done with a “Lashkar,” or armed group. This action was described as alarming. The petition was also supported by an MNA. The Member of National Assembly is from PTI. This unusual criticism targeted their own Chief Minister. It highlighted deep divisions within the party. These internal issues add to the political turmoil.

Reason for the PHC Decision

The High Court deemed the plea inadmissible. This often means a lack of legal standing. It can also signify a technical defect in the filing. The court typically avoids political questions.
